2. Products

• We sell Nigerian/Caribbean and international grocery products as listed on our website.
• Product images are for illustrative purposes; actual packaging or appearance may vary slightly.
• We make reasonable efforts to ensure product descriptions, pricing, and availability are accurate, but errors may occasionally occur. We reserve the right to correct pricing or availability errors, and to cancel any order affected by such an error, in which case you will receive a full refund.

3. Allergen & Food Safety Notice

• Full ingredient and allergen information should be checked on product packaging on delivery.
• Some products are prepared in facilities that also handle nuts, gluten, dairy, and other allergens.
• If you have a food allergy or intolerance, please contact us before ordering at info@toksmimifoods.co.uk and always check packaging before consumption.
• Perishable and chilled/frozen items should be stored appropriately immediately on delivery.

4. Orders and Payment

• By placing an order, you are making an offer to purchase, which we may accept or decline.
• Payment is taken securely at checkout via Stripe (debit/credit cards). We do not store your full card details.
• Order confirmation via email does not guarantee acceptance — a contract is formed only once we confirm dispatch.

5. Delivery

• We deliver perishable goods 24hours after posting. Normal delivery takes 3 – 4working days.
• Estimated delivery times are 3 – 4 working days and are not guaranteed; delays may occur due to circumstances outside our control.
• Delivery is charged at £3.99 for orders up to 2kg and £5.99 for orders over 2kg, calculated automatically at checkout based on the contents of your basket.
• Risk in the goods passes to you on delivery. Please check your order on arrival and report any issues within 2days.

6. Returns, Refunds & Cancellations

• Under the Consumer Contracts Regulations 2013, you generally have the right to cancel an order within 14 days of receipt for a full refund, except where goods are perishable, made to order, or unsealed for hygiene/food safety reasons (which typically excludes most fresh, frozen, and chilled food items once delivered).
• If an item arrives damaged, incorrect, or faulty, contact us within 10 at info@toksmimifoods.co.uk with photos where possible, and we will offer a replacement or refund.
• Refunds, where applicable, will be processed to your original payment method within 5 – 7 working days after receiving back the goods.

7. Pricing & Availability

• All prices are shown in GBP (£) and include VAT where applicable.
• We reserve the right to change prices at any time, but changes will not affect orders already confirmed.
• Products are subject to availability; if an item becomes unavailable after ordering, we will notify you and offer a substitute, refund, or delay.

8. Your Account

• You are responsible for keeping your account login details secure.
• You must provide accurate and complete information when creating an account or placing an order.

9. Acceptable Use

You agree not to misuse our website, including attempting unauthorised access, introducing malicious code, or using the site for any unlawful purpose.

10. Limitation of Liability

• We are not liable for indirect or consequential losses arising from your use of the website or products, except where such liability cannot be excluded by law (e.g. death or personal injury caused by negligence, or fraud).
• Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015.

All content on this website, including logos, text, and images, is owned by or licensed to Toksmimi Foods and may not be used without permission.

12. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
